FXC FOUNDATION GOLF OUTING TERMS AND CONDITIONS

Welcome to our Annual FXC Golf Outing (the "Event"), organized and hosted directly by [The FXC Family Foundation] (the "Charity"). By registering for, purchasing tickets to, or participating in this Event, you ("Participant," "Player," or "Attendee") agree to comply with and be bound by the following Terms and Conditions.
1. Registration, Fees, and Payments
1.1. Registration Process: Registration must be completed through our official online registration portal or via an authorized manual registration form. Entry is on a first-come, first-served basis.
1.2. Payment Requirements: All registration fees, individual player fees, and foursome packages must be paid in full at the time of registration to secure a spot in the tournament field.
1.3. Refund Policy: All event registrations, ticket purchases, and sponsorship payments are final and non-refundable. If you are unable to attend, you may substitute another player by notifying the Charity administration at least 48 hours prior to the event tee time.
1.4. Tax Deductibility: Registration fees cover the cost of greens fees, cart rentals, meals, and player gifts. Only the portion of your payment that exceeds the Fair Market Value (FMV) of the goods and services received is eligible for a tax deduction. The Charity will provide an official tax acknowledgment letter stating the deductible amount after the event.
2. Weather, Rescheduling, and Cancellation
2.1. Rain-or-Shine Policy: The Event will take place rain or shine unless the hosting Golf Course/Country Club management deems the course unplayable or unsafe (e.g., severe lightning, extreme flooding).
2.2. Event Postponement: If the Event is postponed due to severe weather, safety hazards, force majeure, or restrictions beyond the Charity’s control, the Event will be rescheduled to an alternate date. All registrations will automatically transfer to the new date.
2.3. Cancellation: In the unlikely event that the outing is permanently canceled and cannot be rescheduled, your registration fee will be automatically converted into a 100% tax-deductible direct donation to the Charity. No cash or credit card refunds will be issued.
3. Golf Course Rules and Code of Conduct
3.1. Rules of Play: All players must adhere to standard USGA Rules of Golf, modified by any local course rules or specific tournament formats (e.g., Scramble format) outlined during the player briefing.
3.2. Dress Code: Participants must strictly comply with the dress code enforced by the host venue. Generally, this requires collared shirts, slacks or golf shorts, and soft-spiked golf shoes. Denim, jeans, cargo shorts, tank tops, and t-shirts are strictly prohibited.
3.3. Golf Cart Operation: Golf carts must be operated responsibly and only by licensed drivers aged 18 or older. Operators must follow all course directional signs, stay on designated cart paths where required, and accept full financial liability for any damage caused to the cart or the course properties through negligent operation.
3.4. Professional Conduct: The Charity values a welcoming and respectful environment. Abusive language, unsportsmanlike conduct, excessive intoxication, or aggressive behavior toward staff, volunteers, course personnel, or other players will result in immediate removal from the facility without a refund.
4. Liability Waiver, Assumption of Risk, and Indemnification
4.1. Assumption of Risk: Participation in a golf tournament inherently involves risk, including but not limited to injuries from stray golf balls, clubs, golf cart accidents, slips and falls, and unpredictable outdoor weather conditions. By attending, you voluntarily assume all risks associated with participation.
4.2. Waiver of Liability: You hereby release, waive, and forever discharge the Charity, its directors, officers, employees, volunteers, sponsors, and the hosting golf facility from any and all liability, claims, or demands for personal injury, sickness, death, or property damage arising out of your presence at or participation in the Event.
4.3. Medical Consent: In the event of an injury or medical emergency during the outing, you authorize Event staff or venue personnel to secure necessary medical treatment, including emergency medical transportation, at your personal expense.
5. Photo and Media Release
5.1. Consent to Capture: By attending the Event, you acknowledge that photography, audio recording, and video filming may take place in public areas, on the course, and during the banquet.
5.2. Grant of Rights: You grant the Charity an irrevocable, royalty-free, worldwide license to use your name, image, likeness, and voice in promotional materials, brochures, social media channels, websites, and future marketing campaigns without further compensation or prior approval.
6. General Provisions
6.1. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State in which the Charity is incorporated, without regard to conflict of law principles.
6.2. Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect.
6.3. Modifications: The Charity reserves the right to amend, update, or alter these Terms and Conditions at any time prior to the Event. Any material changes will be communicated directly to registered participants via email.
